Uber Service Level Agreement

Any arbitration conducted under this Agreement to Arbitrate shall be administered by the American Arbitration Association («AAA») in accordance with its Consumer Arbitration Rules in effect at the time the arbitration is initiated, as modified by the terms set forth in this Agreement. Copies of these rules may be obtained from the AAA website (www.adr.org) (the «AAA Rules») or by calling the AAA at 1-800-778-7879. Notwithstanding the foregoing, if you request it and if it is reasonable based on the facts and circumstances of the claims submitted, the arbitrator will have the discretion to choose a different set of aaa rules, but in no event will the arbitrator consolidate claims of more than one person or otherwise by any form of representative, collective or collective proceedings. The parties may, by mutual written agreement, elect another conciliation administrator. By becoming a user, you represent and warrant that you are at least 18 years of age. You are responsible for any breach of the above representations, warranties and/or this Agreement and/or any attempt by the minor to refuse this Agreement. We reserve the right, but have no obligation, to monitor materials posted on the Lyft Platform and remove materials that, in our sole opinion, violate the law or this Agreement or purportedly violate the law or this Agreement, or that may be offensive or illegal, or that violate rights; violate or threaten the safety of users or others. We cannot guarantee that every driver will be who they say they are. Please use common sense when using the Lyft platform and ride-sharing services, including photos of the driver or driver you voted with to make sure they are the same person you see in person. Please note that there are also risks in the processing of minors or persons acting under false pretenses, and we assume no responsibility for any content, communication or other use of or access to the Lyft Platform by anyone under the age of 18 who violates this Agreement. We recommend that you communicate directly with any potential driver before using an organized transportation service. These Terms of Use constitute a legally binding agreement (the «Agreement») between you and Lyft, Inc., its parents, subsidiaries, agents, affiliates, officers and directors (collectively, «Lyft», «we», «us» or «our») that governs your use of the Lyft app, website and technology platform (collectively, the «Lyft Platform»). As a driver or driver claimant, you may not avoid the obligation to arbitrate drivers` claims as defined in Section 17(e)(3) under the terms of this Subsection (except as limited by Section 17(i) above), unless you have previously agreed to an arbitration clause in the Lyft Terms of Service in which you have had the opportunity to opt out of the arbitration obligation. If you have already agreed to such an arbitration provision, you may opt out of any changes to your previous arbitration agreement made by this provision in the manner set forth below, but the rejection of this arbitration provision will not affect any past, other or future arbitration agreements you may have with Lyft. If you have not previously agreed to such arbitration provision and do not wish to be subject to this Agreement to Arbitrate with respect to Drivers` Claims, you may opt out of arbitration with respect to such Drivers` Claims, other than those subject to an ongoing settlement action, by notifying Lyft in writing of your wish to withdraw from arbitration for such Drivers` Claims. which pleadings must be dated, signed and sent by e-mail to arbitrationoptout@lyft.com.. .
